Obtaining a Court Order or Injunction
Because allegations of domestic violence are taken so seriously by the courts, it is possible for someone to obtain a temporary order of protection even without showing any actual injury. In fact, the only requirement is your sworn affidavit and petition stating that you fear the person in question will do you harm.
Our lawyers can walk you through the steps you need to take to obtain an initial order. Once that has been accomplished, a second hearing will be scheduled approximately two weeks later. At that hearing, your abuser has the right to be present, and you will be required to show evidence of abuse before the court will make the order permanent.
