The Issues of Divorce
Obtaining an actual divorce decree from the state of Florida is really just the final step in a process. But before that final step can happen, a lot of other steps have to be taken along the way — steps that involve resolving differences and finding answers to questions like these:
- What happens while the divorce is still pending?
- Where will the children live?
- Who gets the family home?
- How should the marital assets, property and debts be divided?
- How much child support should be ordered?
- What is the appropriate time-sharing with the child between the parents?

The Process
So what can you expect in the process and how long does it take? In an uncontested divorce (one where the spouses have agreed on how the major issues should be resolved), the process can take as little as three weeks. More often, however, some back-and-forth negotiation will be required, and this will stretch the process out to about three or four months.
In situations where spouses are far apart on the major issues, a lot more work may be required to avoid putting decisions about issues like child custody or property division in the hands of a judge or jury. In these cases, and in those that do end up in court, the process may take up to one year (or even longer in very complex cases).
